The Fukushima Collective Evacuation Trial Team

On June 24, 2011, 14 children in Primary schools in Koriyama City, Fukushima filed a law suit against the District Court to demand their right to study in a safe environment. In a response, the Koriyama District Court dismissed the case on December 16, 2011. The plaintiffs of 14 the children filed a formal objection at the end of 2011, which is presently pending before the Sendai High Court. This trial calls for the government and court system to take immediate action to evacuate the children in Fukushima collectively. The result of this regional lawsuit will have a strong influence on the evacuation of the children living in the highly contaminated areas in many other places in Japan.

Hundreds of protesters rallied in Shinjuku, Tokyo, demanding evacuation of children from Fukushima

In the afternoon of May 18, 2013, hundreds of people rallied in Shinjuku, Tokyo, demanding the collective evacuation of children from Fukushima, where tens and thousands of children are living with the great fear of irradiation after Fukushima Daiichi nuclear power plant accident. The peaceful march was made under the careful supervision of the police.


400 people, the evacuation trial team and its supporters, together with avid anti-nuclear public figures such as Taro Yamamoto, marched together in the busy Shinjuku streets to raise awareness of the trial among the public. At the rally, participants including Yamamoto and Mika Noro, who has been organizing recuperation programs for Chernobyl children, gave speeches in front of the crowd. The speakers urged the public to take immediate action to support the children of Fukushima, who live in circumstances where the air dose radiation level is much higher than the 1mSv/year, the level originally allowed by the government of Japan.


The plaintiffs claim to evacuate children from Fukushima was rejected by Sendai High Court on April 24, 2013, although the court admitted that long term health risks caused by irradiation may occur in the future, judging from the cases of the Chernobyl nuclear accident disaster.

The Fukushima Collective Evacuation Trial Admits to Adverse Effects of Low-Dose Radiation Exposure on Health

The ruling of the Japanese Court on April 24 rejecting the damand of 14 children in the city affected by the fallout of Fukushima Nuclear Disaster evacuate its children struck the international media including ABC News, Fox News, the New York Times, Washington Post, Guardian, Telegraph, Russia Today, Straits Times. Only one Japanese paper, Tokyo Shinbun News, reported about the decision. The following is the article of Tokyo Shinbun News published on May 3. Knowing all of the mainstream media except for Tokyo Shinbun News failed to report the case, it clearly highlights that there is a serious concern among people about the manupilation of information by the media monopoly undermining the moral value of the Japanese journalism.

 

Although the appeal was rejected, the Japanese High court’s ruling was significant.

 

The lawsuit was filed on behalf of the children of Koriyama City, Fukushima, arguing that the city had a legal responsibility to “provide collective evacuation” of children. The Sendai High Court (Chief Judge Yoichi Sato) rejected the petition for a temporary injunction on April 24. However, the justice clearly recognized there is a legitimate concern that the children who are under constant low-dose radiation exposure might suffer from future health problems.

The Fukushima Collective Evacuation Trial Team is planning to hold a demonstration on May 18 in Shinjuku Tokyo. As the ruling of Sendai High Court last month rejected our claim calling for the city in Fukushima to evacuate its children from highly contaminated areas, we were overwhelmed and disappointed at the decision they made. The decision of the judges, which stated that "the children has no right to evacuate, nor the city has no obligation to evacuate the children", was undoubtedly inhumane and disregards the basic human rights of the children. In Fukushima, there are still thousands of the innocent children are living in a highly dangerous areas. In a mean time, the health condition of the children are becoming highly critical.

"Grim Decision" says Chomsky after Japanese Court Rejected Demand to Evacuate Children

The world-renowned political dissident, linguist and author Noam Chomsky commented on the ruling of Sendai High Court which rejected a demand that a city affected by the fallout of the country's 2011 nuclear disaster evacuate its children.

 

Chomsky said:

 

It is deeply disturbing to learn that the courts have blocked efforts to evacuate children from the Fukushima site, though acknowledging the health risks. Nothing tells us more about the moral level of a society than how it treats the most vulnerable, in this case its most precious possession, its children. I hope and trust that this grim decision will be reversed.

The Fukushima Collective Evacuation Trial Team has just launched a new campaign for Evacuation of the Children from The Highly Contaminated Areas.

The trial team is trying to deliver as many messages as possible to judges from all over the world. On the campaign website, it says:

The Japanese authorities tend to be vulnerable to criticism from abroad. In order to show the strong international interest and support for the trial, the trial support team would like to film as many video messages as possible to the judges from all over the world. In June 2011, 14 elementary and junior high school students from Koriyama City, Fukushima Prefecture, filed a lawsuit demanding their “right to study in a safe environment”. The Fukushima District Court dismissed the case on the same day, in December 2011. On the same day, the former Japanese Premier Noda declared an end to the most dangerous phase of the Fukushima Nuclear Power Plant accident. The plaintiffs, representing the 14 children, filed a formal objection before the Sendai High Court. The Court concluded the hearing after conducting court hearings three times but has not yet decided the case.

Evacuate the Children!: Japanese citizens' demonstration takes place in Shinjuku Tokyo

On February 23, a demonstration for the collective evacuation of the children from the high radiation areas took place in Shinjuku Tokyo. "There were 600 citizens on the street of Shinjuku calling for an immediate evacuation of the children" said a lawyer from the Collective Evacuation Trial Team, the group which organised the demonstration. In the afternoon of one Saturday, the demonstration made a significant appeal to the city workers and students as well as the overseas media reporters passing through the central parts of Tokyo. There seemed to be no doubt that the action taken by ordinary citizens on this day held a significant meaning for which the trial is now considered as the bottom line for preserving the human rights of the people in Fukushima. Soon, the short video filmed at the demonstration including the speeches by the evacuees from Fukushima will follow.

Fukushima Collective Evacuation Trial Team Recieves a Message from Noam Chomsky

As the Fukushima Collective Evacuation Trial Team is going to have a demonstration on February 23 in Shinjuku Tokyo, the team recieved a message from Noam Chomsky, the world-renowned political dissident, linguist and author.

 

The following is the Chomsky's message given to the Trial Team:

 

It is most disturbing -- in fact shocking -- to learn that hundreds of thousands of children remain in areas heavily affected by the Fukushima disaster, and doubtless at serious risk. There can surely be no justification for the failure to evacuate them to safety, without delay. I hope that their actions will bring an end to this cruel policy, which needlessly compounds a terrible catastrophe.

The Fukushima Collective Evacuation Trial Team is planning to have a demonstration on February 23, 2013 in Shinjuku Tokyo. We claim that the direct action taken by ordinary citizens is a very important factor for the court to consider evacuation of the children. Historically speaking, as the Chernobyl disaster contaminated a vast areas of Belarus, the civil protests in 1989 by the ordinary parents pushed the Belarusian government to undertake the Recuperation Projects on a national basis.

 

Even thought our government is not willing to reflect the voices of the citizens on their policies, citizens still must shape the public's opinion by showing the authority what democracy ought to deliver. No matter what they do or do not offer us, we cannot fall into the scilent majority because the future of the children is in our hands.

Japanese testify on radiation hazards at Human Rights Council in Geneva

An anti-nuclear a city like Geneva, what a dream it must be for the Mayor of Futaba, a small Japanese town 3km from the Fukushima Daiichi nuclear power station. Futaba was wiped out by the earthquake and tsunami of 11 March 2011. Because of the radioactivity the population will be unable to return for decades, if ever. The Mayor, Katsutaka Idogawa, came to Geneva at the end of October to testify at the UN Human Rights Council, along with Toshio Yanagihara, lead lawyer of the “Fukushima Collective Evacuation Trial”. Mayor Idogawa was received on 30 October by the Mayor of Geneva, Rémy Pagani, who expressed the sympathy and support of Geneva.

The Report of Sendai High Court

On October 1st, the oral argument and interrogation were held at the Sendai High Court. Many of our supporters from Tokyo, Koriyama and Fukushima came to Sendai on that day. In the interrogation, the presiding judge asked the appellants to assert and prove why the individual children are not able to evacuate by themselves. The appellants submitted the legal brief (the refutation of the assertion from the Koriyama City and additional assertions based on the facts) and new evidence. Although they also proposed the court to allow Dr. Yagasaki and Dr. Matsugasaki to show their opinions from the perspectives of experts about the recent findings that one child in the Fukushima Prefecture was diagnosed as thyroid cancer and that 43% of the children in Fukushima City have a tubercular or a cyst in their thyroid gland, the court did not do so. Furthermore, they claimed to summon Dr. Tomoya Yamauchi and Shunichi Yamashita, the Vice President of Fukushima Medical University, as witnesses, but the court rejected this request.
